Rental Contract and Terms & Conditions
1. Villa Rental - The price quoted and agreed with our tenants is for your personal rental on the dates specified for the use of the villa, pool, and grounds including use of furnishings, utility services and air conditioning. A highchair is available.
- Occupancy - The villa sleeps a maximum of 6. A cot is available if required.
- Maid service - This is provided twice each week including arrival day with linen and towel change midweek.
- Linen - Hand & bath towels and bed linen are provided.
- Smoking - Smoking is not permitted within the villa in any room. Ashtrays are supplied for smoking outside.
- Transportation to/from villa is not provided, however we will be able to offer assistance in arrangements if required.
- Swimming pool - The swimming pool at the villa is to be used at your own risk. A lifeguard will not be present. No diving is permitted and swimming at night not recommended. No glass must be used in or around the pool area. In the event of a broken glass the pool would be required to be drained and cleaned and this additional expense met by the tenant. Plastic glasses have been supplied for your convenient use outside near the pool area. Toys in the swimming pool must be removed after each use to avoid blocking the swimming pool filter system. If this is blocked and the filters damaged any repair costs must be met by the tenant.
2. Check in and check out - The check in time to the villa on the arrival day is from 2.00 pm and on the departure day the villa must be vacated by 10.00 am. The villa will be cleaned and checked for any damages prior to the next guest's arrival. If you do have later flights and the villa is not being occupied the following week, you will be able to check out later.
- Key collection/return - The key is to be collected from the key safe on arrival and returned to the housekeeper or locked up again in the key safe on your departure. The safe code to be advised before arrival.
3. Payments - A non refundable deposit of £200.00 is required to secure your booking and must be received within a week of booking. The final balance to be paid 8 weeks before your arrival date at the villa. Failure to pay on time could result in the loss of your reservation. If you book your holiday within 6 weeks of the departure day, full payment will be required at the time of booking.
4. Cancellation & early termination - If a tenant terminates this contract before the arrival date and doesn't name a replacement that accepts the same terms, they are responsible for paying the following penalty fees in relation to the total rental price to cover costs, as long as a further rental is not possible:
- More than 56 days before rental period: Deposit only
- 55 to 29 days before rental period 50%
- 28 to 22 days before rental period 60%
- 21 to 0 days before rental period 100%
- Should you need to cancel your holiday for any reason, this must be done in writing.
- If a Tenant terminates their stay during the holiday, before the departure date for any reason, they are still obliged to pay the full rental price.
- Refunds - A full refund is available prior to arrival and part there of if your holiday has begun, if the villa is determined by the owner or housekeeper to be un-rentable due to an unforeseen circumstance. As it is a new villa it is highly unlikely anything should go wrong however we are obliged to say this.
- Please note that if the reason for cancellation falls within the terms of your insurance policy, then the insurance company will normally refund any such charges to you.
5. Responsibilities of the Owner
- We the owners do not accept any responsibility in respect of accident, loss, damage, death, injury or illness to any person, property or third parties using our facilities, this includes areas such as interior or exterior of the villa, swimming pool, garden & patio areas and also use of the villa contents.
- Liability and responsibilities of the tenant - We do respect our customers and do not request a security deposit to cover for any damages. The tenant is obligated to leave the villa on departure day as they found it when they arrived. The tenant is responsible for the actions of themselves and of any visitors they may have within the villa or grounds of the property and liable for any damages that are related in any way to the villa and it's contents, pool and grounds. Any such damage must be repaired or replaced prior to your departure; if you are unable, then the required payment should be made to our housekeepers. The villa must not be sublet to any other people. Noise generated from yourselves or equipment that you are using in and around the villa must be kept to a respectable level in consideration of other people in our neighbourhood.
- The tenant hereby acknowledges that they should take out their own holiday insurance to cover for all situations and fully releases the owners of Villa Joanna from any claims that could arise.
- Complaints or disputes - If you do have a problem during your stay, please inform our housekeepers and they will endeavor to put things right during your stay. If your problem cannot be resolved whilst in resort, please submit in writing within 28 days of your return in order for us to be able to investigate the problem.
- Pets - Pets are not allowed at the property, unless guide/hearing dogs.
The contract is made on the terms of these booking conditions. Any disputes will be governed by British Law and both parties shall submit to the Jurisdiction of the British Courts at all times.
If any Legal action is contemplated our authority must be obtained prior to commencement of proceedings. Our costs in respect of the above on behalf of you and your party shall not exceed the total cost of the amount paid for the villa rental.
These conditions are valid from May 2006 until further notice.
